Fresh FIR lodged against RJD MP Md Shahabuddin

The victim, the officer-in-charge (OC) of Barharia police station has lodged a complaint stating that he was threatened with dire consequences by the Siwan MP, reports Ramashankar.

Incarcerated RJD MP from Siwan, Md Shahabuddin, allegedly threatened a prosecution witness on Wednesday in the designated trial court at the Siwan district jail. The victim, the officer-in-charge (OC) of Barharia police station, BK Pandey, has lodged a complaint with the Mufassil police station in this connection.

Pandey alleged in his complaint that he was threatened with dire consequences by the Siwan MP when he reached the designated court of Judicial Magistrate VV Gupta, to depose in two cases — 102/04 and 41/05 — lodged at the Pachrukhi and Hussainganj police stations, respectively.

The two cases are related to theft of vehicles and their subsequent recovery from the MP's residential premises at Pratappur village during a raid conducted there by the Siwan police.

A police officer said that a case had been lodged against Shahabuddin under sections 506 and 353 of the IPC on the basis of the complaint lodged at the local police station. "We are looking into the matter," he said.

On the other hand, the defence counsel urged the court to defer the MP's trial because the Additional Advocate General, Ram Vilas Mahto, was not present in the court. Sources said this was the fourth case lodged against the MP since he was arrested from New Delhi last year.

Meanwhile, the Patna High Court bench of Justice Shyam Kishore Sharma adjourned the hearing on the petition filed by Shahabuddin, challenging the constitution of a special court on the premises of Siwan jail.

The court asked the state prison department to reply within 10 days on the MP's petition seeking his 'production- in- person' before the Muzaffarpur court in connection with a criminal case pending there against him. The court asked the Bihar Inspector General (prison) to mention the difficulties, if any, in producing the petitioner in Muzaffarpur court from Siwan district jail.

The petitioner pleaded to get himself personally produced before SDJM, Muzafarpur, so that he might be remanded in the Kazi Mohammadpur police station case in which production-warrant had already been issued by Chief Judicial magistrate (CJM), Muzaffarpur on December 6, 2006.

The Siwan MP is presently lodged at Siwan jail and despite the direction of Muzaffarpur CJM to produce him there, the Siwan jail authorities had not produced the MP before SDJM (East), Muzaffarpur.

Kazi Mohammadpur (PS case no 182/2005) case relates to MP's LLB part 2 examination at RDS college, Muzaffarpur as candidate from SK Memorial Silver Jubilee Law College, Muzaffarpur when the MP was evading arrest in a number of cases pending against him.
