HC notice to SP MLA in murder case

THE ALLAHABAD High Court issued notice to Samajwadi Party MLA from Gyanpur Assembly constituency of Bhadohi, Vijay Mishra, on a writ petition demanding investigation by the CBI in the murder case of constable Surya Mani Mishra in the year 2003 at Civil Lines locality of Allahabad.

THE ALLAHABAD High Court issued notice to Samajwadi Party MLA from Gyanpur Assembly constituency of Bhadohi, Vijay Mishra, on a writ petition demanding investigation by the CBI in the murder case of constable Surya Mani Mishra in the year 2003 at Civil Lines locality of Allahabad.

In the petition filed by the slain cop’s brother Surendra Nath Mishra, it was alleged that even though Vijay Mishra was named accused in the FIR in the murder case of Surya Mani Mishra, the Samajwadi Party MLA got the investigation manipulated.

First, he got the investigation transferred from local police to CB-CID. Later, the investigation officer was also changed and one Sita Ram Mishra of Lucknow range was appointed as the investigation officer, who submitted the final report in the matter.

Passing the order, a Division Bench comprising Justice Imtiyaz Murtaza and Justice Amar Saran directed the State government to file reply in this case and fixed August 7 as the next date for hearing. While pleading for CBI investigation, the petitioner alleged that about 47 criminal cases were pending against Vijay Mishra in different parts of the State.

HC modifies death sentence to life term: The High Court sentenced to life imprisonment one Chandrakesh, charged with rape and murder of a minor girl identified as Manju (8).

Although the trial court had sentence Chandrakesh to death for the gruesome offence, the High Court, after considering the young age of the accused, converted the sentence to life imprisonment.

The order was passed by a Division Bench comprising Justice MC Jain and Justice KK Misra.

The incident took place on February 1, 2004, in Majhaula village of Budaun district when Manju had gone to the sugarcane field of the accused Chandrakesh along with her five-year-old sister Preeti. Chandrakesh sent back Preeti after giving her one sugarcane and saying that Manju would follow her with more sugarcane. However, Manju never returned as Chandrakesh first raped and then strangulated her with her hair ribbon.

The next day her naked body was found dumped in a nearby field. The hair ribbon was found tied around her neck. The trial judge found the evidence proved and sentenced him to death. However, on considering the pros and cons of the matter, the high court modified the death penalty into life imprisonment.
