HC notices on multi-storey parking

INDORE DIVISION bench of Madhya Pradesh High Court comprising Justice S K Kulshreshtha and Justice A K Avasthi has issued show cause notice to Indore Municipal Corporation and contractors against construction of multi-storeyed parking at Subhash Chowk.

The show cause notice has been issued to Mayor Dr Uma Shashi Sharma, Municipal Commissioner, IMC public works department in-charge Lalit Porwal, first contractor Surendra Godha and second contractor Padma Associates in response to public interest litigation filed by Agniban reporter Rajesh Jwel.

The PIL has charged IMC with flouting land diversion norms and land use. The petitioner, through his counsels M M Asudani and Subodh Abhyankar, said that IMC allowed construction of shops in the basement and parking area contrary to MP Land Development Act provisions.

As per the master plan, Subhash Chowk could be used only for parking, but IMC raised 150 shops on the parking area. Moreover, the complex covers a portion of 60-feet wide road and thus violated building line while leaving no marginal open space and setback land.

There is no provision to alter the original building plan once work tenders are finalised, but IMC not only changed the plan several times but also allotted contract to second firm. Contrary to its regulations, IMC allowed construction of 25 shops without map clearance on 20-feet wide street, the PIL said.
