THE ALLAHABAD High Court on Thursday reserved judgment on a bail application filed by Samajwadi Party MP from Ghazipur Afzal Ansari and his brother Mukhtar Ansari, MLA from Mau, in connection with the BJP MLA Krishna Nand Rai murder case. This order was passed by Justice Poonam Srivastava after hearing both sides at length. On the previous occasion, the court had asked the CBI to file its reply (counter-affidavit), if any, by July 20.

On the previous occasion, the court had asked the CBI to file its reply (counter-affidavit), if any, by July 20. Today when the case was taken up, the CBI counsel sought further time on the ground that he had not been supplied with documents of this case. However, the court heard the case and reserved its verdict.
Appearing on behalf of the applicants, their counsel and former Advocate-General of UP Virendra Bhatia, said, “If you are continuing with the investigation of this case, the applicants should be released on bail under section 167 of Criminal Procedure Code, according to which the accused are entitled to be released on bail if the chargesheet is not filed within 90 days.”
He also said that the evidence collected by the police in this case were is not sufficient to involve Ansari brothers in the murder case of Rai.
Besides, the statements of alleged witnesses had been recorded quite late, he argued.
Opposing the bail application, government counsel Vijay Shankar Mishra contended that the offence was serious as seven persons along with Rai had died.
Besides, there was a strong motive as Rai had defeated Afzal from Muhammadabad Assembly constituency of Ghazipur.
Both Ansari brothers are in jail for the last six months in connection with the Rai murder case. Their bail application was already rejected by the Sessions Judge, Ghazipur. Rai, along with his seven aides, was killed on November 29, 2005. A named FIR was lodged against the Ansaris.

Those present in the meeting observed two-minute silence as a mark of respect.
