The directions came from the division bench headed by justice SK Mittal during the resumed hearing of a petition moved by the Centre.

The Centre had challenged the order of the Chandigarh bench of CAT passed on December 8, 2011, invalidating orders passed by the Centre to withhold Rathore's pension.

However, Rathore had questioned the Centre’s decision before the high court.
