A DIVISION Bench of the Allahabad High Court has set aside an interim order passed by a single judge of this court on September 27 in connection with the UPSEAT-2006-07. In the interim order, the judge directed the UP Technical University (UPTU), Lucknow, to fill up the remaining seats by holding counselling of the candidates on the basis of merit in UPSEAT.

In the interim order, the judge directed the UP Technical University (UPTU), Lucknow, to fill up the remaining seats by holding counselling of the candidates on the basis of merit in UPSEAT.
The single judge directed that if the seats remained vacant even after counselling, the UPTU get the permission to fill up these seats on the basis of the merit of qualifying examination (10+2) etc.
However, setting aside the interim order, the Division Bench requested the single judge to decide the writ petition finally and expeditiously, preferably within three weeks.
Setting aside the interim order, the court observed that since the interim order was of final nature, it deserved to be dismissed.
Passing these directives, a Division Bench comprising Justice Dr BS Chauhan and Justice Dilip Gupta turned down the request of the appellant to permit them to fill up the vacant seats on merit basis on its own.
The court permitted the appellant counsel to make such a request before the single judge.
The court passed the above order on a writ petition filed by the Welfare Association of Self-Financed Institute of NOIDA, an association of private engineering colleges.
About 5,000 seats remained vacant even after the UPSEAT- 2006-2007.
The petitioner, on behalf of the private engineering colleges, put forth a demand before the single judge seeking permission to fill up the remaining seats on the basis of ‘management quota’.
They moved a writ petition before the single judge, requesting him to direct the State Government not to interfere in their functioning.
