The accused, Sanjay Kumar alias Shailender Puri, was booked under Sections 363 (kidnapping), 376 (rape), 506 (criminal intimidation), 419 (cheating by impersonation) of the IPC and under Protection of Children from Sexual Assault Act (PCSAA).
A fine of Rs 10,000 has also been slapped on the accused.
The orders read that the accused has been held guilty on all accounts and has been sentenced for seven years for kidnapping, 10 years for rape, 2 years for criminal intimidation, 2 years for cheating and 10 years under PCSAA adding that all sentences would run concurrently.
The prosecution claimed that the fake Sadhu had abducted a 16-year-old girl of a village in Barara area, following which an FIR was registered against him on December 18, 2012. He was then arrested on December 28, 2012, from Kurukshetra.
It is asserted that under the assumed name, the alleged Sadhu used to give sermons to villagers and during one such discourse, when the minor came in contact with him, he enticed her and kidnapped her when she was going to school.
The prosecution said that during captivity, the accused raped her on several occasions and had taken her to Yamuna Nagar and Haridwar as well.
Complainant's advocate Navneet Mehta informed that during investigations it was revealed that earlier the fake Sadhu was imprisoned for life for murder in Kanpur in Uttar Pradesh and had escaped from custody from Hardoi adding that he was also involved in a minor kidnapping case at Dhand village in Kaithal district.
Mehta informed that the accused had taken up a plea that he was impotent, adding that the plea was later rejected after the medical examination.
After escaping from custody, the accused disguised himself as a preacher at a village temple, where several villagers paid a visit, including the victim, who too came in contact with him during such visits.
