Addressing a seminar organised by Samvaad, a group of lawyers, on ‘Mediation’’ at Judges Guest House here on Friday, Justice Katju said that both lawyers and judges were working under tremendous pressure due to delay in disposal of cases.
He said if the cases were not decided for quite a long time, the people would adopt extra-constitutional methods. Several mal-practices crept in due to delay in disposal of cases, he said and added that if the situation was not changed, the lawyers would be losers. In his keynote address, senior advocate Sriram Panchu, termed mediation as the fastest dispute redressal system.
He said that it was an expansion of boundaries of legal practice and lawyers were going to use their skill in a different way. He said that mediation was different from Lok Adalats. Here mediators did not decide a case at all.
“Rather, it is the parties who decided a matter by reaching a mutually acceptable agreement with the help of a mediator,” he added.
Panchu, who is a trained mediator, said that lawyers could be the best mediators.
He said that such matters where relationships were involved could be resolved through mediation like employee and employer, husband and wife relationship.
A senior High Court judge Justice BS Chauhan and other trained mediators, Geeta Ramsheshan and Aparna Basu, also addressed the gathering.
The programme was conducted by Jayant Banerji. Besides, several sitting judges and senior advocates, prominent others who attended the programme included SFA Naqvi, Shashi Kant Gupta, Sanjiv Singh, Siddharth Verma, Ajay Bhanot, Arnab Banerji and Shamboo Chopra.
