THE SUPREME Court has refused to lift the stay on the Andhra Pradesh High Court judgment quashing an act providing 5% reservation for Muslims in educational institutions and government jobs in the state. It has referred the issue to a Constitution bench.

Admitting a batch of petitions challenging the HC order which invalidated the law, a three-judge bench headed by Chief Justice Y.K. Sabharwal, however, said those who had already availed of the benefits would not be disturbed. Andhra Pradesh had initially brought in an ordinance introducing the quota and later replaced it with an act. Both were struck down by the HC.
