MADHYA PRADESH HIGH Court on Thursday directed the State Government to take steps to appoint Chief Information Commissioner (CIC) and ten information commissioners (ICs) in the State Information Commission.
A division bench comprising Chief Justice A K Patnaik and Justice K K Lahoti issued the interim direction while hearing a public interest litigation (PIL) filed by one Sunil Kumar Tiwari. The petitioner has sought direction to the State Government in this regard as thousands of appeals under the Right to Information (RTI) Act, 2005 are pending before the State Information Commission.
The petitioner said failure on part of Madhya Pradesh State Electricity Board (MPSEB) to provide certain documents sought by him has prompted to file this PIL for appointment on the posts in the State Information Commission, where his appeal is pending for last four months in this regard.
The delay on part of the State in appointing the statutory functionaries in the Commission is violative of the fundamental rights enshrined in the Constitution of India, he said.
The PIL said that the Governor appoints the CIC and ICs on recommendation of a three-member committee comprising Chief Minister, the Leader of Opposition in the State Assembly and a cabinet minister nominated by the CM. The State is without a CIC since the last — and first— incumbent TN Shrivastava retired on October 31 last year.
