In case of PA Inamdar, the Supreme Court had held that admission to professional courses should be based on merit following the combined entrance test result and no capitation can be charged.
The PIL filed by Rajesh Singh, a student leader, prayed that almost all private engineering colleges in UP have filled in 15 per cent management quota in violation of the Supreme Court directive. It was done after charging the capitation fee, the PIL added. Thus, it demanded an inquiry into the matter by any independent agency, the PIL added.
A Division Bench comprising Justice RK Agrawal and Justice Vikram Nath has directed that the case be taken up October 9.
