A clear picture, according to authorities, however, would only emerge after they verify the documents of each and every tenant. “Before initiating any eviction exercise, we would first have to examine the tenancy documents. This is imperative because the Supreme Court order,” said SDM Raid.
The apex court, he said, had ruled that persons claiming possession, prior to the appointment of the Custodian declaring the property of Raja of Mahmudabad as enemy property, based on duly authenticated tenancy created by the then Raja of Mahmudabad or his general power of attorney shall not be covered by its judgment passed on October 21, 2005. Meanwhile, another 8-10 tenants have sought more time to furnish proof of their tenancy, according to sub-divisional magistrate Manoj Rai, the managing officer of the properties. Asked whether the administration would initiate eviction proceedings against those who had not submitted any documentary proof concerning their tenancy, the SDM said it would take another day or two for them to decide future course of action.
Going by the records available with the administration authorities only 22 tenants came under the post 1965 category and hence faced eviction as the premises was allotted to them by the Custodian of Enemy Property.
