The Bandra police on Monday arrested a 40-year-old man and is searching for his wife in an alleged voyeurism case where the man shot a sex tape of a woman with whom he was having an affair. The accused’s wife was booked as she leaked the clip from his phone and circulated it on WhatsApp, the police said.

The arrested accused was having an extramarital affair with a 40-year-old woman, who is the complainant in the case, the police said. The man, his wife and the complainants are all residents of Bandra (West).

The accused and the complainant knew each other for the past five years. They had entered into a physical relationship last year.

Without the complainant’s knowledge the accused clandestinely shot videos while they were getting intimate. The videos were shot and hidden by the accused on his mobile phone.

However, the wife of the accused suspected that he was having an affair and checked his mobile phone earlier this month. When she found the sex tape, she allegedly circulated it to some people known to the complainant, including the complainant’s brother-in-law, in a bid to defame her.

Last week, the complainant’s brother-in-law called her to his house and showed her the video. On learning that her lover’s wife had circulated the clip, the complainant approached the Bandra police station. The police registered an FIR on Sunday under section 354 C (voyeurism) of the Indian Penal Code and 67 A (punishment for publishing or transmitting of material containing sexually explicit act) of the Information Technology Act. The accused was arrested soon after and produced before a magistrate. He was remanded in police custody till January 30.

While the defence lawyer argued before the magistrate that the accused is innocent and the couple was in a relationship, public prosecutor Priti Jagtap argued,”Although the couple were in a relationship, the accused clandestinely shot a video and made it public using WhatsApp.”

A police official from Bandra police station said, “We have seized his mobile phone. We will send it to the forensic lab.”
