RInfra set to get Mumbai plot allotted in 1959, following high court order to BMC

The BMC assured court that it will remove the 28 encroachers on the 708 sqm plot in Santacruz and hand it over within six months

Reliance Infrastructure (RInfra) Limited will soon get possession of a 708 square metre plot in Santacruz (east) that had been allotted to the erstwhile Bombay Suburban Electric Supply Limited (BSES) 59 years ago, in 1959.

The Brihanmumbai Municipal Corporation (BMC) assured Bombay high court last week that it would clear all 28 encroachers from the plot within six months, hand it over to RInfra.

The BMC was responding to a plea filed by RInfra seeking implementation of an earlier court order that directed the corporation to hand over possession of plot No. 102.

In August 1959, two adjoining plots — nos. 102 and 103 — in Santacruz (east) were allotted to BSES under the town planning scheme that came into effect the same month. Though plot no. 103 was handed over soon, the company did not get possession of the other plot.

The company approached the Bombay high court in June 1979 and secured an order in its favour. The matter was, however, taken to the Supreme Court by Ramsurat Pandey, who had rented the plot from its original owner for one year in February 1951, but had continued on the plot after that.The high court had declared that he was a trespasser and had no right to the property. The apex court confirmed the high court order, after which Pandey filed a civil suit in the city civil court seeking a declaration that he had become the plot owner through adverse possession. When the court did not rule in his favour, Pandey took the issue to the Bombay high court and then to the SC, but lost the case.

RInfra then approached the high court seeking implementation of the 1979 order that directed the BMC to hand over possession of the vacant plot to the electricity company. Now, the BMC has assured the court that it will clear the encroachers and hand the plot over.
