Michael Jackson's mother on Monday filed a petition in a local court seeking legal guardianship of three children of the 'King of Pop' who died of cardiac arrest last week.
A hearing was scheduled for August 3 on Katherine Jackson's petition filed in Los Angeles Probate Court, according to CNN.
"We're not trying to get custody. We will get custody and have custody," Joe Jackson was quoted as saying by the channel.
Michael Joseph Jr, 12, Paris Michael Katherine, 11, and seven-year-old Prince "Blanket" Michael II have reportedly expressed their desire to stay with the late 50-year-old singer's mother.
But Debbie, mother of Prince Jr and Paris, told a friend she wanted full custody of the youngsters, just two days before the singer's death last Thursday.
Sources close to the Jackson family say Katherine will "fight tooth and nail" to stop Debbie getting the youngsters. They claim the former dental nurse signed away her parental rights in return for a house and a multi-million dollar lump sum.
Debbie, 50, reportedly went to lawyers last December after Jackson's biographer claimed the star was suffering from a chronic lung condition and had just months to live. She demanded more access to her children, saying, "I'm their mother and they need me."
While some reports suggest that Jackson left two wills others suggest that Jackson left a will at all. The document could set out his choice of guardian for the kids.
