“The position Tata Sons has taken in its affidavit filed in the Delhi High Court is in line with what we have stated from the outset–that Tata Sons is committed to honouring our contractual obligations to NTT DoCoMo, in compliance with Indian regulations and law ,” said a Tata Sons spokesman.
In the affidavit, Tata Sons had objected to the enforcement of the arbitration award given by the London Court of International Arbitration on the grounds that the award contravenes Indian public policy and the fundamental policy of Indian law.
Tata Sons dispute with NTT Do Co Mo pertains to a clause in the shareholder agreement between the two companies, under which the Tatas were to find a buyer or buy back the 26% equity stake DoCoMo holds in Tata Te le services, in the case of an exit by the Japanese partner.
