As per the order, Gian Singh was convicted under Section 8 (punishment for sexual assault) of the Protection of Children from Sexual Offences Act. He was fined ₹5,000 by the court.
The defence appealed for leniency citing that Gian Singh is a heart patient and had stents inserted four months ago. They added that his son is in the army and there is no one to look after his wife.
The public prosecutor contended for maximum punishment “as a deterrent and a message be sent to such persons in the society.”
Pronouncing the judgment, the court said, “The man committed sexual assault on the minor girl when she had gone to his house to return the balance amount for the article ordered by his wife. Cases of sexual assault are on rise and minors need to be protected from such harm.”
The court recommended the District Legal Services Authority to award a compensation of ₹30,000 to the survivor.
