Anand Teltumbde walks out from jail after 30 months

Teltumbde is the third accused in the case released on bail after co-accused Varavara Rao and Sudha Bharadwaj. Rao was granted bail on medical grounds whereas Bharadwaj was given default bail. Teltumbde, however, is the first accused in the case to get bail on merits after the high court noted that the evidence adduced by the NIA did not show that he indulged in a terrorist act, punishable under UAPA.

Mumbai: After 30 months, academician and human rights activist Anand Teltumbde was released from Taloja jail in Navi Mumbai on Saturday. The development came a day after the Supreme Court dismissed National Investigation Agency’s plea against the Bombay high court order granting him bail.

The 73-year-old walked out of the jail around 1:30 pm. His wife Rama Teltumbde, some other family members and MLC Kapil Patil greeted him outside the prison. Speaking to reporters outside the jail Teltumbde said he was happy to step out in the open after spending over 30 months behind bars. But, he said, it was sad that he was incarcerated though he did not commit any wrong.

Teltumbde, however, is the first accused in the case to get bail on merits after the high court noted that the evidence adduced by the NIA did not show that he indulged in a terrorist act, punishable under UAPA.

“The seizure of the incriminating material, does not in any manner prima facie lead to draw an inference that appellant has committed or indulged in a ‘terrorist act’ as contemplated under Section 15 of the UAPA,” the high court had said in its November 18 order while granting him bail.

The high court had asked Teltumbde to submit the names and contact details of two persons to the investigating agency and allowed him to be released on depositing the cash of 1 lakh. Accordingly, his lawyers on Friday deposited the amount in the sessions court registry and also submitted the names and contact details of two of his relatives – to enable them to communicate with him, if needed.

The case was registered at Vishrambaug police station in Pune on January 8, 2018, based on a complaint lodged by Tushar Damgude, a builder by profession. He complained that members of the Communist Party of India (Maoist) incited violence by creating communal disharmony.

According to him, the members of Kabir Kala Manch spread hatred through provocative songs, plays and speeches delivered at the Elgar Parishad conclave held at Shaniwar Wada on December 31, 2017, which gave rise to widespread violence at a war memorial at Bhima Koregaon in Shirur taluka of Pune district.
