Financial status not sole criterion for custody

A city court has denied a father the custody of his minor child stating just his financial status cannot be considered as the reason for grant of child’s custody.

Noting that the child’s welfare is the sole criterion for decision in such cases, Additional Sessions and Civil Judge Gautam Manan refused Delhi resident Mohd Faizayab’s plea seeking his son’s custody from his separated wife and allowed him to visit his son once a month.

The court noted a guardianship court is not the platform where litigants can be permitted to settle scores and play out their grudges.
