Govt yet to take a view on Article 309: Moily

Extending support to the demand for removal the Article 309 from the IPC, noted lawyer Ram Jethmalani on Wednesday said it should go, but Law Minister Veerapan Moily said the government is yet to take a decision on it.

Extending support to the demand for removal the Article 309 from the IPC, noted lawyer Ram Jethmalani on Wednesday said it should go, but Law Minister Veerapan Moily said the government is yet to take a decision on it.

“It (Article 309) is a foolish provision and it should go,” Jethmalani said.

Article 309 of the IPC deals with prosecution of a person who fails in attempted suicide bids.
The Law Commission has recently recommended removal of the Article from the IPC.

Commenting upon the recommendation, Law and Justice Minister Veerapan Moily, however, said, “no decision has been taken and the government is yet to take a view on it.”

On a question whether Prime Minister should make a statement on the issue of influencing a Madras High Court judge by a Union minister, Jethmalani said, “Unless there is a proper inquiry into the issue, how can the PM make a statement on it?”
