HC to trail courts: E-mail bail orders to Tihar jail

For expeditious release of the undertrials and convicted persons who were granted bail, the Delhi High Court on Wednesday directed all trial courts as well as its own registry to e-mail the copy of bail orders to Tihar Jail authorities for quick action.

For expeditious release of the undertrials and convicted persons who were granted bail, the Delhi High Court on Wednesday directed all trial courts as well as its own registry to e-mail the copy of bail orders to Tihar Jail authorities for quick action.

A division bench of chief justice Dipak Misra and justice Sanjiv Khanna accepted the suggestions given by the Delhi Legal Services Authority (DLSA) and said the bail orders should be sent to the jail authorities through e-mail so that the undertrials should not suffer due to delay.

The bench also accepted the DLSA’s suggestion that the jail authorities inform the family of the undertrials/convicts so that they would take steps to meet the bail conditions. In addition, the court accepted the suggestion that the bail grant registrar, in which the list of bail granted by the court concerned is maintained by jail authorities, would be examined by a judge to ascertain the reasons why any convict or undertrial was not released despite a bail order.

The high court registry was also directed to send all the bail orders to the concerned trial courts as well as the jail authorities through e-mail.

The court was hearing a PIL seeking a direction to the competent authorities to make some arrangement for some of the undertrials/convicts who have been languishing in jail despite bail orders but they failed to furnish sureties before the concerned trial court.
