Krishna’s bail application rejected

A Ghaziabad court rejects the bail plea of Krishna, compounder of Dr Rajesh Talwar and an accused in the Noida double murder case.

A Ghaziabad court on Monday rejected the bail plea of Krishna, compounder of Dr Rajesh Talwar and an accused in the Noida double murder case.

Filing the bail plea, Krishna's lawyer FC Sharma said: "Krishna is being falsely implicated in this case as he is a servant. He is in illegal detention of the CBI since May 16 and has been subjected to various medical and scientific tests against his wishes. There has been no evidence recovered to prove his involvement in the murders. His involvement in the case is a cooked story by the CBI. The case diary is fabricated and false. So Krishna should be released on bail."

CBI counsel RK Saini countered the defence lawyer's request. Saini said that the case does not fall under sub-section of CrPC 437. "Under this section, bail can be granted by the Magistrate only if the accused is under age of 16 or medically unfit. Such is not the case in this matter," Saini further said.

Rejecting the bail plea, Special Judicial Magistrate (CBI) Sapna Mishra said if the charges lead to either life imprisonment or death penalty and they do not fall under certain provisions of CrPC 437, the magistrate is not entitled to grant bail to the accused.
