Arvind Kumar surrendered before the police after injuring his children, Vivek (9) and Latika (8), while they were asleep on May 17, 2004 at his house under Kotla Mubarakpur police station in south Delhi.
The prosecution said the convict was under a disturbed state of mind as his wife Santosh had gone to her parental house. He also suspected she was having illicit relations with someone else, the prosecution added.
Additional Sessions Judge J.R. Aryan, however, ordered the release of convict Arvind Kumar on probation of two years for good conduct after furnishing a personal bond of Rs 25,000 and one surety of the same amount.
Even though the court convicted Kumar, it did not take into account the testimonies of his two kids saying they were living with their mother who might have tutored them. The court noted that the police had recorded the witnesses’ statement after a long delay.
