The court said an order cannot be passed as the petitioner, an IAS officer, had not given any representation to the competent authority before approaching this court. He can send his representation to the competent authority, the court said.

The bench said petitioner MS Devasayam, a Chennai- based retired IAS officer, can make a representation to the Union home ministry within a week.

The petitioner sought quashing of Kumar's appointment, alleging that he has been facing several charges of misuse of power and human rights' violations, which had come in way of his selection as the CBI director.
