SC defers Mulayam's hearing in DA case

The apex court said the matter could be heard only after the summer vacation as the decision of a Constitution Bench relating to the courts' power of ordering CBI probe is yet to be pronounced.

"That one question which is going to be Bible to the pending matter has not yet been decided," a Bench comprising Justices Altamas Kabir and H L Dattu said.

"Accordingly, let the matter stand adjourned till July 30," it said.

The brief order evoked quick reaction from Mulayam's counsel who said "by that time, the heat will be down".

When the matter had come up for hearing last on April 1, the Bench deferred it after being informed that the judgement of a Constitution Bench on the validity of the courts ordering CBI probe was awaited in the first week of May.

Mulayam has filed the review petition questioning an earlier directive of the apex court ordering a preliminary inquiry by the CBI into his and the family's "disproportionate assets."
