“If the IB wants to absolve itself of the responsibility of the killings, it is free to get a court order,” CBI director Ranjit Sinha told CNN-IBN.

Sinha also said the law does not permit the killing of a person even if his or her involvement in terror activities was suggested by intelligence agencies.

In its first chargesheet filed on Wednesday, the CBI had said Jahan and three others were murdered in cold blood by a joint team of Gujarat Police and the IB. Kumar has not been named in the chargesheet, but his role might figure in a supplementary chargesheet the agency is expected to file soon.

As local head of the IB in June 2004, Kumar and other IB officials are said to have created a false intelligence input that said the four persons were on a mission to kill Gujarat chief minister Narendra Modi.
