Woman gets Rs3 lakh for wrong treatment

Three years after her root canal treatment (RCT) was done incorrectly by a team of dentists exacerbating her pain, a woman was awarded a compensation of Rs3 lakh by the district consumer dispute redressal forum (DCDRF).

Mayank Raghava, the lawyer of patient Seema Kumar, said, “My client had visited Smile & Shine Dental Care Centre, DLF 2, owned by Dr Rajat Sethi, for treatment in April 2016. A team of two doctors conducted the RCT procedure to treat her problem but she continued to have pain after the RCT.”
“After not getting relief, my client decided to visit the Airforce Medicare Centre in Delhi Cantt where it was confirmed that the root canal treatment procedure was incomplete. She then decided to move the consumer forum against the dentists,” he said.
Kumar moved the forum in September 2016. In December 2018, the consumer forum referred the matter to Civil Surgeon, general hospital, Gurugram, to ascertain the report of incomplete root canal treatment.
The consumer forum order said, “Civil Surgeon confirmed medical negligence on part of the team of doctors at Sethi’s centre. So we direct Dr Rajat Sethi to pay a lump sum amount of Rs3,00,000 to the patient cum complainant within 30 days of receiving this order, failing which an interest of 9% will be levied.”
Ehraz Zafar, Dr Sethi’s lawyer, said, “We are not happy with this order and we will challenge this order in the state consumer dispute redressal forum within 30 days.”
