Minor burnt 12-year-old girl in Nagaon rape and murder: Charge sheet
Assam police on Friday filed a charge sheet against eight persons in the gruesome rape and murder of a 12-year-old, detailing how the three main accused, including two minors, took turns to rape her and then burnt her alive when she threatened to expose them.
The girl was raped in a small hut in Nagaon on March 23 and she died at Guwahati Medical College and Hospital the next day. However, before her death, she had named the accused to the police.
The 158-page charge sheet, according to Shankar Raimedhi, superintendent of police, Nagaon, identifies three persons — 19-year-old Zakir Hussain, 12-year-old cousin of the victim and a 11-year-old boy, who went to the same school as the victim — for the rape and murder.
Five others, including Abdul Rajek, Hussain’s father, his mother Zubeda Khatoon, brother Mukhlesur Rehman and his brothers-in-law Abdul Rashid and Fakhruddin, have been accused of destruction of evidence, harbouring the accused and a criminal conspiracy, according to Raimedhi.
“It was Zakir Hussain who raped her first, followed by the two minors on the afternoon of March 23,” a police officer said, quoting the charge sheet.
The three had entered the girl’s house in Lalungaon, a predominantly Muslim village in Batadrawa in Nagaon.
When the victim threatened that she would tell about the incident to her family, her cousin got hold of a container full of kerosene and tried to pour it on her, a police officer involved in the investigation said, adding that since the container was too big for the little boy, most of it spilled on the floor.
“Zakir then took it from him and doused her,” the other police officer said, adding that one of the minors then lit her.
Police claimed that the three got together at Zakir’s insistence and went to the victim’s house.
“Zakir’s wife had been away for eight months,” the official said, adding how it is part of the evidence in the charge sheet, with sexual frustration as a possible motive for the crime.
“He would watch pornography on his phone and is perhaps a drug addict,” the police official said.
A police officer said that the girl’s statement before death, in which she had named the three accused, was “crucial piece of evidence” even though they have witnesses, who saw them fleeing.
“While there are no eyewitnesses to the incident, the neighbours saw the three escape from the house. Their statements are part of the charge sheet,” the police official said.
The family of the victim, including the parents and an elder sister, was not in the house at the time of the crime, the police said.
The two minors are in an observation home in Jorhat while Hussain, who was earlier booked in a theft case, is in judicial custody in Nagaon Central Jail.
“The incident is shocking,” Raimedhi said, adding that the police was quick in taking the case to its logical conclusion.
BJP MP Meenakshi Lekhi had mentioned the Nagaon case in a bid to attack the opposition and Congress for focussing on a few rape cases after Rahul Gandhi led a candle light vigil over the Kathua and Unnao rape cases.
