Rahul Gandhi disqualified highlights: Row erupts between BJP, Congress

Congress leader Rahul Gandhi has been disqualified as a member of Lok Sabha a day after the Surat court convicted him for two years in a defamation case. However, he was granted a 30-day bail in the case to allow him appeal in a higher court. 

The Lok Sabha secretariat said in a notification that he has been disqualified from the day of the conviction under the Constitution’s Article 102(1)(e) read with Section 8 of the Representation of the People Act.

Gandhi attended the Budget session on Friday briefly before the Lok Sabha was adjourned for an hour and later convened for the day. The Surat court convicted the Congress leader over his remark he made in Karnataka ahead of the 2019 Lok Sabha election where he wondered ‘how all thieves have Modi surnames’.

As a next step, the Wayanad MP will have to appeal to the higher court seeking a stay on the conviction, in order to prevent the disqualification and the Congress said it will follow the procedure to move a higher court.

    Here's what Rahul Gandhi's disqualification notice says

    Congress leader Rahul Gandhi has been convicted in a criminal defamation case for his ‘Modi surname’ remark and has been given a two-year term by a local court in Gujarat. The court has also granted him a 30-day bail to allow him to appeal in a higher court.

    Following this, he has been disqualified as a member of Lok Sabha on Friday. 

    Here's what the notice from Lok Sabha Secretariat says:

    “Consequent upon his conviction by the Court of Chief Judicial Magistrate, Surat in C.C./18712/2019, Shri Rahul Gandhi, Member of Lok Sabha representing the Wayanad Parliamentary Constituency of Kerala stands disqualified from the membership of Lok Sabha from the date of his conviction i.e. 23 March, 2023 in terms of the provisions of Article 102(1)(e) of the Constitution of India read with Section 8 of the Representation of the People Act, 1951.”

    An elected representative sentenced for any offence for two years or more faces immediate disqualification under the Representation of People Act, 1951. Read more

    Why has Rahul Gandhi been disqualified? 

    Lok Sabha MP from Wayanad constituency Rahul Gandhi has been disqualified from the House on grounds of a conviction charge against him over a defamation case. A local court in Gujarat has given the Congress leader a two-year term for a remark he made in Karnataka ahead of the 2019 Lok Sabha election where he wondered ‘how all thieves have Modi surnames’. 

    Any elected representative sentenced for any offence for two years or more faces immediate disqualification under the Representation of People Act, 1951. One provision of the Act that granted three-month protection from disqualification was struck down in 2013 as “ultra vires” by the Supreme Court in the Lily Thomas case.
