5 brothers get 3-yr jail term for assaulting lady

A court in New Delhi on Tuesday sentenced five brothers to three years rigorous imprisonment for assaulting an old lady following a dispute over her pet dog.

Additional Sessions Judge Rajinder Kumar convicted Jaswant, Davender, Baloo, Kinnu and Kanhiya, all residents of Vivek Vihar in east Delhi, for assaulting their neighbour Chandrawati, 68, who later died in a city hospital on the fateful night itself.

Earlier, all were charged for committing the murder of the victim.

But, later the court, considering the deposition of a doctor that the victim died due to "Asphyxia", a respiratory disorder, not because of the assault, withdrew the murder charges.

Finding all the five guilty under section 148 (rioting with deadly weapon), 149 (common intention of rioting mob) and 323 (causing hurt) of the IPC, the ASJ also imposed a fine of Rs 3,000 each on them.

The court, though convicted their septugenarian mother in the case, but ordered her release considering her old age.

As per prosecution, the pet dog of the victim, on the night of March 25, 2002, started barking upon Davinder, one of the accused, when he was passing through the street.

Few minutes later, Davinder along with his family members, who were armed with iron rods, came and entered to a verbal duel with her. Later, they physically assaulted Chandrawati who later died in hospital.
