The court was obliged to order Abdul Rahman's release because he had already been held in jail for a month, deputy attorney general Mohammad Ishaq Aliko said.
"We had to free him, he is free now. I have just sent an official letter to the ministry of justice to release him," he said.
Prison officials said however they had yet to receive notice to free Rahman, being held a maximum security jail on the outskirts of Kabul and the case against him has not been dismissed.
