Bail to rapist father on technical grounds

Court grants bail to a man, accused of raping his 13-year-old daughter since 2004, as the police failed to file a charge-sheet within time.

A local court has granted bail to a man, accused of raping his 13-year-old daughter since 2004, as the police failed to file a charge-sheet within stipulated 90-days.

The accused arrested on November 20 last year, was granted bail by Additional Sessions Judge RY Ganoo as the investigating officer failed to file the chargesheet against Baitullah Khan (41) within the stipulated period.

Ironically, the chargesheet was filed on the 91st day, giving the benefit to the accused, allowing him to get bail due to the delay.

While the victim had informed her mother a number of times of the repeated rape, Baitullah threatened his wife to keep quiet.

Meanwhile, she developed severe pain in stomach and was taken to the doctor by her mother for treatment. Later, after her medical examination, it was revealed that she had an abortion.

On November 2 last year, when the girl had enough and could not take it anymore, she went and told her neighbours about the repeated rapes by Baitullah. The neighbours sheltered her and later took her to the Oshiwara police station.

While recording the girl's statement, the fact that she was illiterate and helped her mother at home, came through.

The chargesheet was filed on February 20, technically leading to Baitullah's freedom on bail.
