Drama over demand to cancel Tewari?s papers

RETURNING OFFICER ADM (Finance) Uday Veer Singh rejected the demand of former corporator Tilak Singh for the cancellation of the nomination papers of Congress mayoral candidate Badri Narayan Tewari. Singh is a known supporter of the Samajwadi Party (SP) candidate Neeraj Chaturvedi.

Singh’s counsel Divendra Kumar Sharma demanded the cancellation of nomination papers of Tewari on grounds of concealing facts related to a criminal case filed against him about 43 years ago. He said Tewari had concealed the criminal case filed against him. The high-drama at the Kanpur Municipal Corporation (KMC) is seen as an outcome of the SP-Congress rivalry.

“Concealing facts in the nomination papers is tantamount to an illegal act,” Sharma stated.

Rebutting the charges, Tewari’s counsels, Surendra Pratap Singh and Satya Prakash Srivastav, said the court had absolved their client of the charges leveled against him about 43 years ago.

“Even the Municipal Act states that the nomination papers of a candidate should not be rejected by the RO on ground which are not of substantive in character,” argued Surendra Pratap Singh.

During the hearing of the case, district president of the SP Nasiruddin, general secretary Jitendra Bahadur Singh and other SP leaders were also present.

Delivering the judgment, ADM (Finance) Uday Veer Singh said that the nomination paper of Tewari had been accepted.

The RO observed, “As per Supreme Court ruling, nomination papers of a candidate cannot be cancelled on charges of concealing facts. The provision of presenting all the facts has been made to make the public aware of the aspects of a candidate.”

38 nominations cancelled

THIRTY-EIGHT NOMINATION papers filed for the corporators’ seats were cancelled during the scrutiny process, here on Thursday.

In all, 942 nominations were filed during the nomination process that began on October 5. Now, after cancellation, 904 candidates are left in the fray for the corporators’ seats. The last date for withdrawal of nomination papers has been fixed for October 15.

Notably, all the 18 nomination papers filed for the mayoral seat were approved during the scrutiny process.
