Convicting Shamsher Singh for killing one Rakesh Kumar Gupta, Metropolitan Magistrate Digvinay Singh also imposed a fine of Rs 6,000 on him.

Dismissing minor technical shortcomings in the prosecution case, the court observed, "Investigating officer not being examined is not fatal to the case. Quality of the witness is more important than the quantity of the witness and the contradictions are not material enough."

The prosecution examined 11 witnesses to establish their case.

On November 10, 1991 at 7.30 pm in the evening, the victim Gupta's scooter was hit from behind by the DTC bus driven in a rash and negligent manner by Singh in the Punjabi Bagh area of north-west Delhi.

The bus dragged the scooter for a while and crushed the head of the rider under its wheel injuring him fatally. Shamsher Singh was apprehended on the spot.
