The BJP took the Navin Chawla issue to the Supreme Court. Senior leader Jaswant Singh on Friday sought removal of the controversial Election Commissioner on the ground that he would not able to discharge his duty impartially in view of several allegations of improprieties levelled against him.
The petition by the Leader of the Opposition in Rajya Sabha has referred the representation of 205 MPs for Chawla's removal as EC saying that he would not discharge his duty in fair and unbiased manner as the trust run by his wife had taken donations from Congress MPs from the MPLAD fund.
Quoting media reports, the BJP leader said in the petition the procedure followed by the government for advising the President in the matter was contrary to the provisions of the Constitution when representations were made against Chawla.
He has contended that instead of referring the matter to the Chief Election Commission for his view, it was referred to the Cabinet.
Singh also said the cabinet had taken the advice of the Attorney General who had opined that Chawla was fit to continue as EC as the allegations levelled against him were of past.
A similar petition filed by Samajwadi Party MP Chandra Bushan Singh was also pending before the apex court.
While seeking removal of Chawla, the PIL by the SP leader has contended that he was unfit to discharge his function as EC as the Shah Commission, which was constituted to investigate into the excesses committed during the emergency has given several findings against him.
He has also alleged that the Lepra India Trust run by his wife Rupika Chawla received donations from Congress MPs.
