KMC staff moves HC for pending salary, bonus

Petitioner and Karamchari Sanyukt Morcha joint secretary Harbajan has made the State Government, Municipal Commissioner Badal Chatterjee and KMC Chief Accounts Officer PN Singh party to the writ petition. He has cited a ruling of the Supreme Court that payment of salary was a legitimate right of an employee.
The petitioner has also asserted in the petition that KMC had already received a grant of Rs 44 cr from the state government for the first half of the financial year spanning from March to September 2006. Out of this an amount of Rs 7.41 cr is still in the PLA account. Another ground put forward by the petitioner for payment of salary and bonus is the grant of Rs 48.55 cr received by the KMC for second half of the financial year (from October 2006 to March 2007).
Meanwhile, KMC employees’ union leader Prakash Hazare said that when KMC had enough funds in its PLA account the employees must get their wages without any further delay. “Payment of pension has nothing to do with the salary of employees. Employees must get their salary as they have nothing to do with the pension matter,” he said.
It may be pointed out that the Allahabad High Court had imposed a ban on all payments, including payment of salary, made by the KMC. The order was given by the court on a writ petition filed by pensioners’ association demanding payment of their pending dues which amounted to Rs 70 cr. In compliance of the High Court’s order the KMC had not distributed salary to its employees for the month of September and October and because of this about 6,900 employees were not able to celebrate Diwali and Id.
It may be recalled that the Allahabad High Court had raised an objection on the first writ filed by the KMC employees’ union on the issue of court fee. The registrar had pointed out that the court fee at the rate of Rs 125 per employee of the KMC had to be submitted by the employees’ union.
November 8 had been fixed as the next date for hearing of the case.
Life term to murder accused: Judge of Fast Track Court (I) Mangal Prasad of Kanpur Dehat awarded life imprisonment to a murder accused.
According to government counsel Phool Singh Yadav, accused Afzal of village Rasoolpur under police station Barur was found guilty of murdering Isrial, a resident of the same village on May 22, 2005.
On the day of the incident, the deceased was sleeping with his wife in his house. At about 10.30 pm, accused along with co-accused Guddu, also of the same village, reached the house and fired from a country-made pistol, killing Isrial on the spot.
