In his appeal, Santosh, son of a former IPS officer, contended that his acquittal by the trial court was "correct and proper" and the High Court’s finding did not have any basis in the evidence on record.

A Bench of Justice RS Sodhi and Justice PK Bhasin of the High court had on October 17, 2006 reversed the trial court verdict acquitting him of the 1996 rape and murder of Mattoo.

The High Court had sentenced him to death on October 30 last year saying he deserved nothing less. The acquittal of Santosh by the trial court in 1999 had led to a public outcry.
