The chief judicial magistrate in Panaji directed that copies of the CCTV footage from cameras outside the lift be made and given to Tehelka co-founder Tarun Tejpal. On Tuesday, Tejpal had moved an application before the court seeking a copy of the footage which he has said is the basis of his defence.
He was served a copy of the chargesheet on Tuesday with 200 odd printed shots of the footage and subsequently alleged that the police was not playing fair by hiding a crucial piece of evidence that he was entitled to.
There were no cameras inside the lift where Tejpal is alleged to have sexually assaulted a junior colleague in Goa in November; the footage is from cameras outside the lift.
When the matter was heard in the chief judicial magistrate's chamber on Wednesday morning, the prosecution did not object to Tejpal being a given a copy of the footage and said that they themselves did not have a copy. The footage was submitted to the court as part of the seizures made by the police.
"The court has directed that copies be made by officers under the supervision of the court and copies be given to both sides," said Raunaq Rao, Tejpal's counsel, after the hearing.
The seizures, which are with the court will be opened in the evening today in the presence of lawyers from both sides and court staff and copies be made subsequently.
"The supply of the CD of the CCTV footage, besides forming a part of the defence of the accused is the most empirical evidence pertaining to the instant matter as the same goes on to establish the innocence of the accused.," his application said. It goes on to say, that the supply of the footage is "not only imperative but also necessary for a just and fair adjudication of the instant case."
