In an affidavit filed on behalf of the young MP, senior advocate Keshri Nath Tripathi said that the petition, seeking cancellation of Gandhi's election on the ground of his involvement in a case pertaining to an alleged hate speech, was not maintainable as it had been delivered much before the elections and could have no bearing upon the poll process.

The petition has been filed by V M Singh, Gandhi's maternal uncle who had unsuccessfully contested from Pilibhit on a Congress ticket in the general elections held last year.

Justice S K Tripathi posted the matter for further hearing tomorrow.
