Passing this order, a Division Bench comprising Justice MC Jain and Justice KK Mishra directed to list the case on April 12 for next hearing. The court passed this order on a habeas corpus writ petition filed by Humera Khatoon, wife of Waliullah. Appearing on behalf of the petitioner, her counsel Vinay Saran contended that Waliullah had been illegally detained. He requested the court to direct that he be produced before the court so as to examine whether his detention was legal or not.
HC concern THE ALLAHABAD High Court has taken a serious note of non-filing of affidavits timely in the court by the State government.
Advocate-General SMA Kazmi has assured the court on behalf of the State government that he was going to hold the meeting of Principal Secretaries of each and every department, especially on the issue of timely filing of affidavits in the court.
On the assurance given by the Advocate-General, a Division Bench comprising Justice Amitava Lala and Justice Shiv Shankar exempted the personal appearance of Principal Secretary (Home) UP Government, who was present in the court as per previous directions of the court. The court passed this order on a petition filed by Sardar Satpal Singh.
The court said, “It has been marked that in the absence of affidavits, the courts are facing a lot of problems in disposing the matters at the earliest. Principle of delay defeats the law squarely applies in such situations.”
The Court had summoned the Principal Secretary in the court despite several orders having been passed by the High Court, no one appeared before the court, nor any counter affidavit was filed on behalf of the State government.

A meeting of lawyers, held under the presidentship of High Court Bar Association secretary Rakesh Pandey, which was presided over by High Court Bar Association treasurer Himanshu Singh, demanded immediate arrest of guilty persons.
