The police had claimed Sheikh died from a drug overdose but a post-mortem report said his body had external and internal injuries and there was no evidence of drug use.

Rejecting the state's plea for a stay so that the matter could be appealed in the Supreme Court, a division bench of the court ordered the immediate suspension of the three officers and said they “neither trust the executive magistrate nor the DCB-CID [Crime Branch] to conduct a fair inquiry”.
