Indian student held in US arbitrarily, claims father

“The whole trial has been arbitrarily conducted without any considerations to natural justice and due process of law. This case should be of national interest because what happened to Vikram can happen to any Indian studying in the US.” This is what Subbarao Buddhi, father of Vikram Buddhi, said.

Vikram, an Indian student, is arrested in the US for allegedly posting material threatening former president George Bush, on the Internet.

Subbarao said, his son, a PhD student at Purdue University, was detained on February 3, 2006 and questioned for over two days by the Secret Service.

They made a formal report saying Buddhi was not a threat to Bush or any Secret Service protected person. However, he was arrested on April 14, 2006, and found guilty of being a threat to Bush in 2007.

Subbarao, a nuclear scientist and Supreme Court advocate, said, “The indictment mentions Vikram is accused of threatening Bush, but fails to mention the content on the web.

There are judgments in the US judiciary, which say that advocacy of violence is protected speech unless there is a chance of imminent danger, meaning that even if he had posted the content, he could not have been found in violation of any offence.”
