The Sewri sessions court was to frame charges against the six accused on Thursday.

The court, while hearing the discharge plea by one of the accused, Kundan Raj Borgohain (22), stayed framing of charges till January 5. The matter will come up on January 4.

The girl was allegedly gang-raped at Borgohain’s Juhu home. Borgohain had approached the HC, seeking discharge from the case. He contended he “came in the picture only at a later stage when they [other accused] came to his place”.

He is the only one of the accused who was granted bail by the high court in September 2009.

“The prosecutrix (victim) has not specifically said she had sexual intercourse with anybody either in her FIR or in her statement...” said Borgohain’s plea.

It said that, as admitted in the FIR and the victim’s statement, he was introduced to her only on that night. The medical exam and chemical analysis report has said it is not clear Borgohain had any part.
