It has permitted them to appear for the third year examination after the University of Pune refused permission.
A division bench of chief justice Mohit Shah and justice SJ Vazifdar on Wednesday permitted Ishan Darekar and Pravin Patil to appear for the third year examination which will be held in March or April.
The duo was barred from appearing in the third examination by the university because they had not cleared the Allowed To Keep Term (ATKT) papers for the previous two years.
Darekar and Patil approached the court after the University of Pune told that they were ineligible to appear for the examination.
The university counsel Girish Kulkarni, said the duo had not cleared one ATKT paper in the first year and three ATKT papers in the second year.
According to University Rules for ATKT, unless the first ATKT papers are cleared, they cannot appear for the third year, said Kulkarni. Pooja Throat, the petitioners' advocate, argued that according to the rules framed by the Council of Architecture, the apex body of architecture colleges, the students have to complete the three-year course within five years.
If they keep detaining students every year due to ATKT, then they would be disqualified for the course. "In the present scenario, the students would take six years to complete the course. This would automatically render them disqualified for the course," said Thorat.
Besides, the council permits them to carry four ATKT papers of the previous years, argued Thorat. Kulkarni supported the petitioners and the court permitted the students to appear for the examination.
However, the court did not grant the plea that the university should declare their results.
The court has kept the petition for final hearing in March.
