NEW DELHI: People kept in prison for longer than their sentence should be compensated for their illegal detention as a matter of policy, the Central Information Commission has said.

The panel also ordered Tihar jail to pay Rs 11,000 to a Faridabad resident who was released four days late despite numerous RTI requests filed by the man’s son to know the date of his father’s release.

Once out of jail in 2015, OP Gandhi too filed information requests with Tihar jail to figure out who was responsible for the delay of his jail term. He was sentenced in a 2010 cheque bouncing case.

Gandhi’s appeals reached central information commissioner M Sridhar Acharyulu when Tihar did not give him clear-cut answers.

In a 17-page decision, Acharyulu also told Tihar jail to come up with a transparent policy on remission of jail term including the compensation to be paid to people for their extended stay in jail.

“A poor prisoner Rudul Shah got Rs 30,000 for 14 years of extra detention while an MLA Bhim Singh was given Rs 50,000 for one day’s false imprisonment,” he said.
