Noida homebuyers demand FIR against Jaypee promoters, meet SSP

A delegation of around 20 buyers reached SSP office in Greater Noida’s Surajpur and demanded immediate registration of FIR against Jaypee Group’s promoters for justice.

Homebuyers on Tuesday submitted a complaint to the Gautam Budh Nagar senior superintendent of police Love Kumar against the Jaypee Group promoters. Buyers demanded that an FIR under the charges of cheating and fraud be lodged against Manoj Gaur, managing director and Sameer Gaur, director of Jaypee Group. Buyers met the SSP in his office and filed the complaint.

The Jaypee Group had in 2013 launched multiple flat schemes and plot projects without necessary approvals and collected money in 2013. The Jaypee Group has collected around Rs300 crore from nearly 3300 buyers in nine realty projects named _ Aman-III, Boulevard Court Apartment, Budha Circuit Studios-II, Naturvue Apartments, Tanishq Square, Sunnyvale Homes, Udaan, Villa Expanza Sunnyvale Homes and Yamuna Vihar plots. The housing scheme never got approved but still the builder collected funds from buyers. And now the scheme stands cancelled since 2016 and the builder is not refunding the money.

SSP Kumar said that he has directed circle officer to examine buyers’ allegations. “Buyers have shown me the reply of the RTI application filed by them which in itself is a strong evidence against the Jaypee that started selling flats without approval.”

“If the allegations are proved, we will file an FIR,” he said.

“We filed an application under the right to information act-2005 to seek information whether the Yamuna Expressway industrial development authority sanctioned maps for these nine realty projects located in sector 22B and 22C next to Budha International Circuit on 165 km Yamuna Expressway. The Yamuna Expressway authority in reply admitted that they never sanctioned building maps for such projects. It means the Jaypee collected money without having the mandatory approvals from local authority. Therefore, it amounts to cheating and action should be taken against them as per law,” said Nikhil Chandel, a buyer.

“I invested Rs8.18 lakh in Budha Circuit Studio-II in 2013. And now four years after the builder has refused to refund my money. The builder has not started any construction at the site yet. How can a builder collect Rs300 crore without even having mandatory approvals? Should not the Yamuna authority book this builder for cheating and fraud as he works in their area?” said Rajdeep Lalvani, a buyer.

Homebuyers said that the Yamuna authority should have acted in 2013 when the builder started selling flats without approvals in place. Buyers demanded that at least the government should ensure refund and a legal action against the builder without further delay.

“The Uttar Pradesh government has ordered audit of builders’ accounts. So the accounts of Jaypee will also be audited and justice will be done to the buyers,” said Dr Prabhat Kumar, chairman of Yamuna authority.
