Elgar Parishad: second application demanding cloned copies of seized docs filed

Surendra Gadling, Arun Farriera, Rona Wilson, Sudhir Dhawale, Mahesh Raut, VV Rao and Vernon Gonsalves who are accused in the Elgar Parishad case filed a second application on Monday, demanding the cloned copies of the documents seized by the police during their arrest. An application under Section 207 of The Code of Criminal Procedure,1973 have been filed by the accused.
However, by the time Shoma Sen and Sudha Bhardwaj could reach the courts premises, the days’s proceedings were over. This is the second such application by the accused; the first one was part of the several application filed along with the bail application.
Advocate Shahid Akhtar, representing Mahesh Raut, had also appeared in court on Monday and wished to put forth Raut’s December 2018 application, demanding the cloned copies of the seized documents. However, no hearing took place . When Gadling asked special judge KD Vadane about the decision in the bail application, the judge said that the order cannot be passed on Tuesday.
“We cannot pass a bail order in one day, with applications pending in the court,”said judge Vadane. In the next hearing the police are directed to record they say in the matter of cloned copies.
In an earlier hearing the police, through district government pleader Ujjwala Pawar, had asked the accused to obtain the copies from court registry. However, advocate Barun Kumar, representing one of the accused, refused to do so citing technical limitations in verifying the veracity of the documents which are not handed over directly by the police.
