HC stays CBI court’s order in Sachan death case

Of the seven persons summoned, four had moved the HC challenging the CBI court’s order and got the stay order. These four included former UP DGP Karamvir Singh, former additional DGP VK Gupta, former IG (Lucknow zone) Subesh Kumar Singh and former jailor Bhim Sain Mukund.

LUCKNOW The Lucknow bench of the Allahabad high court stayed the order of special judicial magistrate, CBI court, in deputy CMO Dr YS Sachan death case, in which the court had summoned seven persons, including former UP DGP on Monday, as accused to present their views on the case.

The court of the special judicial magistrate, CBI, had earlier termed the June 22, 2011 death of deputy CMO (family welfare) Dr YS Sachan murder and not suicide after taking into account several documents submitted by the deceased’s wife in court.

The then DGP Karamveer Singh, additional DGP VK Gupta and IG, Lucknow zone, Subesh Kumar Singh, were summoned by the court on August 8. The court had also issued summons to the then jailor of Lucknow prison BS Mukund, deputy jailor Sunil Kumar Singh, chief prisoner warden (bandi rakshak) Babu Ram Dubey and bandi rakshak Pahindra Singh, as accused in the case, to present their views on August 8.

Sachan was found dead in the toilet of the district jail hospital. A key accused in the alleged multi-crore National Rural Health Mission scam between 2007 and 2012, he was also the key suspect in the murders of two chief medical officers (CMO) – Dr Vinod Kumar Arya and his successor Dr BP Singh.

Of the seven persons summoned, four had moved the high court challenging the CBI court’s order and got the stay order. These four included former UP DGP Karamvir Singh, former additional DGP VK Gupta, former IG (Lucknow zone) Subesh Kumar Singh and former jailor Bhim Sain Mukund.

A single-judge bench of Justice Ajai Kumar Srivastava on August 5 passed four stay orders on the four different petitions, staying the July 7, 2022 order of the special judicial magistrate, CBI court.

The CBI court had summoned the seven persons on August 8 to present their views on the case on the plea of Dr Malti Sachan, wife of late Dr YS Sachan.

Advocate Sharad Pathak, who appeared on behalf of former jailor Bhim Sain Mukund, challenged the special CBI court’s order arguing that his client was innocent. Pathak pointed out that the applicant (jailor) was not handed over the charge of jailor at that time.

Appearing on behalf of the CBI, advocate Anurag Kumar Singh apprised the court that the central investigation agency had twice filed its closure report in the case, terming the death of Dr Sachan as suicide and not murder.

The court gave two weeks’ time to the opposite parties to file counter affidavit.
