Delhi doc faces arrest for female foeticide

A Delhi court has dismissed the bail application of a doctor accused of female foeticide. Additional Sessions Judge C.K. Chaturvedi noted that Dr Subhash Gupta — owner of Aggarwal Nursing Home in Shastri Nagar, east Delhi — aborted a female foetus without the consent of the mother and hence, rejected the bail application.

A Delhi court has dismissed the bail application of a doctor accused of female foeticide. Additional Sessions Judge C.K. Chaturvedi noted that Dr Subhash Gupta — owner of Aggarwal Nursing Home in Shastri Nagar, east Delhi — aborted a female foetus without the consent of the mother and hence, rejected the bail application.

The court took into account an opinion from a medical specialist of Safdarjung hospital, who said that the ultrasound report and Pre-Natal Diagnostic Test form of consent was not filled up (which is mandatory). Failing this, an offence was made out.

Sheila (name changed), in an FIR lodged in June 2010, at the Shastri Nagar police station (against her husband, in-laws and doctor), stated that after the ultrasound was performed at the Aggarwal Nursing Home, she was told that she was carrying a female child, which should be aborted as soon as possible.

Sheila, however, contended that she told the doctor she was unwilling to do so.
