Issuing notice to the DDA, Registrar Co-operative Societies and Jawahar Lal Co-operative Group Housing Societies (JLCGHS) Ltd, a Division Bench of Justice Madan B Lokur and Justice Sidharth Mridul sought their response by April 6 on a petition filed by P Namgyal alleging that DDA failed to allot a flat to him despite his fulfilling all formalities.

Appearing for the petitioner, his counsel M Tarique Siddiqui told the Bench that Namgyal, a former Union Minister is a resident of Ladakh region of Jammu and Kashmir and falls under the Scheduled Tribe category.

The lawyer submitted that DDA in February last year, asked all flat applicants to submit either Permanent Account Number (PAN) or detail about the Income Tax returns with an affidavit.

Submitting that even though people from Ladakh region were exempted from filing income tax returns under the Income Tax Act, Siddique told the Bench, that his client got his PAN card from IT department and submitted the same before the DDA.
